Connecticut, First Offense, Sleeping In Inoperable Car

Card image cap

Location: Connecticut

So, I went out with my friends on Friday. One friend was the DD for my car, we went to a friends and then the bar until about 2am. When we returned to my car it was driving rough/wierd and after pulling out of lot a check engine light turned on and car was stuck in neutral. He let it roll to side of the road and I tried to troubleshoot. It stated “shifter system malfunction” and no matter what we tried it would not fix. Car would not move in any gear mode, engine was reviving but no movement. So he turned off car, and I told them I’d have to tow it. We went to my friends house to grab our stuff, and I told them I would wait for the tow since it’s my vehicle and it was almost 3am so they could leave. I had someone drive me back to my car down the street and I intended to order a tow and uber home. Due to my being impaired I fell asleep while waiting for the uber. I woke up 2hrs 30 mins later to the cops knocking my window. The uber was canceled due to me not showing up due to being asleep. The cop had me preform FST which I failed and was arrested. I know it’s tricky territory being intoxicated while parked, but keys were not in ignition, and vehicle was inoperable. I have proof of the inoperability, is this case very difficult to win? I know the major argument is did I drive the car to where it broke down or not. I don’t have much to corroborate this except location proving my friends were with me, their uber receipt, and some text telling me I should leave the car and uber home, or go to my friends down the street and check on car in the morning. I did not just leave it because I live an hour away and would not know where it was taken or towed if it was “illegal parking”. I didn’t think I would be able to get a dui too since I wasn’t driving it. What is a realistic scenario based on everyone’s experience in court for DUI? Or any advice? I aim to argue that they cannot prove I was operator, I don’t have much proof aside from location but technically they don’t have any, and I have a lot of proof of the car being inoperable with timelines
