Contract Did Not Go As Planned

I had hired this guy to do some work on my home I have paperwork and recordings of the transaction my signature plus his and also a video of him stating that I had paid him in full before the job was completed the project was estimated to be a 2 day project total cost 2,500 750 deposit which was deducted from the 2,500 remaining amount 1,750

On the 14th of January the guy came out and started doing the job the sanding part was a 10 hours process but he only stayed 7 hours at the end of the day I gave him the rest of the balance he was pose to come back out the next day which was the 15th of January he lift his tools over my house that why I gave him the remaining amount.

later that day I received a video from him saying he just left the hospital he had nerve damage and can we reschedule another day for him to come back out ( the project started on the 14th-15th ) which was a Wednesday and Thursday and was pose to be completed on the 17th of January on a Friday.

I told him my availability which was the 26th-27th of January and he agreed to that. so When the day came I received a message from him saying can we start on the 27th instead of the 26th because of the conditions of the weather. I just asked him for a refund because the project is already 4 days behind.

So he agreed to the refund and also came and picked up equipment upon arrival he had the police with him he said he had the money in the car so once he took some of his stuff to the car he came back and said he left the money at home the 1,750. So he got all his stuff and I don't have a refund.

Even though I have the police on camera plus him saying he has the money and him getting all of his stuff. Is there any actions I could take about this situation
