Cops Cited Me For A Misdemeanor For Alleged 1st Offense Smoking Pot In Park, Despite The City Ordinance Saying 1st-3rd Times Are Infractions With $100, $250, $500 Fines For Each New Offense. Only If One Has Had 3 Convictions Within A Year, Per The Municipal Code, Can It Be A Misdemeanor.

How likely is it that I'll have to spend 6 months in LA county jail and/or have to pay $1000 for allegedly smoking a fucking joint in public?
I have no money and am homeless, too, and fear the cops just want to get me in jail.
I think the cops tricked me by telling me to be honest (I have before about minor things--car being parked in one spot too long, for ex.--and they always appreciated my honesty and never cited me), saying it was an infraction with a fine.
When I saw the citation after they left (it was dark out), misdemeanor was marked versus infraction despite my never being convicted for said crime, ever.
Wouldn't a judge laugh at a misdemeanor rap for one joint? I'm praying the jail is overcrowded and if they pursue the misdemeanor versus the correct first infraction and fine of $100, they would at least divert me to a drug program or community service?
I'm destitute and can't hire a lawyer, and the stress is already killing me. Haven't eaten or slept for days and barely functioning, and my court date isn't for months.
