Dmca Takedown / Copyright Infringement Case
Location: London, UK. Lawsuit: International.
A fake business cloned my website. I sent a DMCA takedown to Shopify. The other party sent a counter notice back with a ghost address and a fake phone number. Shopify wants me to serve the address and open a court case. I supplied my trademark and 100's of pieces of evidence to Shopify, they don't care.
I will not spend $5000-$10,000 on a lawyer, especially when the persons information is fake. The ghost address is in Texas, USA, I am in London, UK and the fraudster is in Pakistan.
I proved to Shopify the person is not registered at the ghost address. They sent me this:
Hi there,
If you attempted service at the provided address and it was returned or refused, please provide evidence demonstrating this.
If you have filed an action seeking a court order to restrain the Merchant from engaging in infringing activity, pursuant to section 512(g)(2)(c) of the US Copyright Act, please let us know by sending us all necessary court documents.
Once received, we will take the appropriate steps to address this issue.
