Dog Attacked Me (level 4 I Think) And Cooperative Home Owner, How Do I Aporoach Her Insurance?
I was attacked by a lose pitbull. I have 4 puncture wonds in my knee and can not (for now) easily walk and can not do my normal activities. The dog did not have its shots this is in hawaii so no rabbies in the state but certainly risk of other infections. The police were called by a helpful neighbor and a report was filed with them and animal control. I went to ER and they cleaned it, gave me a lidocan injection, stitched the openings and gave me antibiotics.
The dog belonged to the home owners son who (accoring to the neigbors) is a jobless drug addict who doesnt care for his dog and has just been living with mom. The mom is very sweet and cooparative and said she has home owners insurance.
The dog has an outdoor cage but cries when he is in it so the owners mom said the son usually chains the dog instead. But the dog was not chained or got lose.
The neighbor who heard me screamed witnessed that the dog was not restrained when she heard me scream and is willing to be witness if needed. I have gps log of my route and where i was attacked.
The neighbors say other neighbors carry around a baseball bat when walking by because the dog is dangerous. i have run this route several days a week for years. But it's far enough away from where I live that I did not know that. i run early enough that there have never been any other walkers going by when I run by. it is a very quiet street/loop that you wouldn't go down unless you live there.
Currently i am in a lot of pain and cannot do my normal activities. I run two businesses and i'm highly athletic.
Though i'm frustrated at the situation, i dont want the mom to be screwed. I just want her insurance to cover what is reasonable for the pain and suffering and the medical bills.
In hawaii I messaged a couple of injury lawyers (i think some of them even said dog bite on the website), and I mentioned I got attacked by a dog and asked if they take such cases. but all the lawyers here say they don't handle that sort of thing. 2 said the way it is usually handled is just by filing a claim through her insurance. I dont know how to do this. The woman is in her 80s and still works and was very sweet. Her son is a jobless drug addicted and is the problem. I don't want her life to be screwed i just want what is reasonable from the insurance for pain and suffereing and bills.
But I also hear that the insurance companies will try to basically screw me over.
I do also want them to be required to have a fence, but I realize it's unlikely to be able to force that through insurance. but if there is a way I would like that, because the neighbor basically says everyone in that immediate area is terrorized by that dog.
I really have no idea how to approach this. Any advice appreciated... it seems that using a lawyer this is someone for being attacked by a loose dog isn't really a thing and i dont know much about working with insurance claims... very lost.
