Employee To Be Terminated But Has Company Owned Items (california)

Card image cap

Location: California
Sub Contractor in Construction

An employee we hired about a month ago is not performing at the expected (and communicated) level and has in-fact messed up on numerous projects with the final straw going to cost our small business thousands of dollars to fix on a project with our most high end GC we would like to keep a great reputation for.

Our issue now is this employee has a company owned van, gas card, and Laptop. This employee is also on a scheduled vacation for the next two weeks (luckily falling in between payroll dates).

What is the appropriate course of action in retrieving these items back from him? Do you notify him now while on vacation? Notify him when he’s back and pay him for the day and offer to pay for an uber home? Can we go retrieve the van with a spare key, but what if his tools are still in there?

Just spit balling here but I would like to do this the correct and also most “humane” way. He’s not a bad guy, he is just unfortunately a liability at this point.
