Fl 39.509 Grandparnets Rights Question

The statue in question

I am not a direct party to this conflict.

My mother and brother have had a falling out. My mother would like visitation with the (elementary school age) grandchildren.

If it matters, my brother is divorced from the the children's mother. They share custody and are both the biological parents.

The relevant portion of the statute is:

"...a maternal or paternal grandparent as well as a stepgrandparent is entitled to reasonable visitation with his or her grandchild who has been adjudicated a dependent child and taken from the physical custody of the parent...."

My mother has the idea that this applies to her. My reading is that this applies to children in foster care, or where the current guardian otherwise has no natural relationship to the grandparents.

Is my reading on or off the mark? If I'm off, what does the bolded text actually mean?

I understand that any lawyers are not my lawyer. I am not considering any legal action, just trying to understand the situation better.
