Florida Hospital Security And Staff Allowed Estranged Family Member Into Nicu Without Parents Consent

Do I have a case to sue the hospital for medical negligence?

In March of 2026, my local Hospital's security and nurses allowed an estranged family member access to the NICU to hold, feed, change, and gather medical information regarding our baby without our knowledge and without me or my husband present. The medical information given to the family member resulted in them weaponizing CPS against me and husband. This caused severe emotional distress for me, resulting in insomnia, depression, and anxiety requiring me to have ongoing care from multiple mental health physicians. I believe the hospital should be liable for allowing someone to access the "Level 3 Security" unit and into any baby's room without the knowledge or permission of the parents.

If this is a case, what kind of lawyer do I call that would take my case and what steps can I take to ensure this doesn't happen to any other parents?

To add additional information: I did look up on Google first to see if this has happened to anyone else in the U.S. and found an almost identical case back in 2022 where parents sued the hospital for emotional distress for allowing a stranger access to the NICU where he proceeded to hold, feed, and change the babies diaper while gathering medical information from nurses without the parents knowledge or consent. A lawyer took their case and was able to settle out of court with the hospital. Unfortunately, this case happened in Idaho so I'm unaware if the laws are different from Florida laws preventing any lawyers from taking this case.

TIA
