Immigration Firm Holding $4k For Halted Asylum Case After Minimal Work. Advice?
Paid a $4,000 deposit on a $7,500 full-service affirmative asylum package (includes I-589/EAD filing, evidence, mock interview with former officer, and representation).
Work done in 1.5 months:
- One intake call (personal statement)
- Initial draft of personal statement
- Drafted (unfiled) Form I-589
- One final call where we mutually agreed to halt the case
I sent back the personal statement with edits, but it was never reviewed. No evidence sent was viewed by the attorney, no mock interview, or filing ever occurred.
When the case was halted, I requested an itemized accounting and a refund of the unearned portion.
The issue:
-The firm is ghosting me.
-They claim "substantial work" was done.
-The managing attorney hung up on me when I pressed for an accounting.
Attorneys cannot keep unearned retainer fees, and $4,000 for an unfiled draft and two brief calls is completely disproportionate.
Please advice
What should i do, i am so distraught after they hung up on me, he was beyond rude and impossible to talk with.
And if someone has been in a similar situation, how did you deal with it.
