Had A Lien Against Someone, They Bought Property And Got A Mortgage. Company Closed And Didn’t Collect My Money
Location: Cape Coral, FL. In 2023 I won a small claims case against the contractor that was paid in full the day. He started a job and then didn’t come back and finish it., clearing the trees and bushes off a lot. The lien is about 3000 bucks. Two weeks after the court case I went and registered the lien against him and his company with the state of Florida and registered the lien with sunbiz against him and his company. Five months later in December 2023 he went and bought a $400,000 property and got a mortgage. Nobody collected the money for the lien and I was not paying anything in January 2026 He just took out a second mortgage. I contacted the mortgage company and the closing company told them what was going on and ask them for the title insurance information to put in a claim they told me it was none of my business and they could not deal with me, as I was not a part to the transaction . What good is a lien if people can still buy real estate get mortgages and second mortgages when they have a lien filed against them with the state? Can I sue the closing company or the mortgage company for not collecting my lien ?
