I Need To Withhold My Last Months Rent. What Should I Expect And What Should My Roommates Who Continue Living Here Expect?

Hi everyone

So my landlord sucks. Long story short, new management took over the building and claim that old management "Spent all our security deposits on legal fees.".

This, obviously, is not our problem and is their responsibility. My only recourse is to withhold my last months rent. Through other tenants who have left this building I've learned that this company will never get those funds back to you and I have no expectation of them to.

When the lease is up I'm getting out of here but I have a few roommates who want to stay. We're getting together later this week to discuss it all and see what makes the most sense. What I'd expect to happen is the landlord could continue to come at them over my unpaid rent as they're easier to mess with and get access to if I leave.

I attended a tenant legal clinic in my neighborhood to find out more info as well as did a New York Bar Referral and they both said the same thing, that of course the responsibility is on the landlord to get those funds back to us regardless of what they claim happened. I've had small claims court suggested quite a bit.

All that to say my question is basically the title. I think it would be best if we were all in the same boat but that isn't an option for everyone.
