I Think My Company Is Taking Advantage Of Us. How Can I Approach This?
About 6 months ago, I got hired for a job as a roofing supervisor. This job had all the “family first” and “people over profit” kind of thing on their website and all their socials. It caught my attention and I submitted an application and long story short, I got hired. It was a salaried job (40 hours guaranteed a week Monday - Friday with weekends off) with great benefits so I thought I hit the jackpot with a unique opportunity.
During my orientation, or “cultural development” as they called it, they talked so much about the culture of the company. The HR guy was saying things like, “here in this company, we are all family and this place is almost like a second home for a lot of the employees.” ”Since people loved working for the company, they have done so much for the company out of love and passion” and shit like that. They stressed that since this place is like our second family, we must also help this company like how we would with a family member. Sometimes without expecting anything in return. It seemed strange but I needed this job. Plus I kept on thinking the benefits would outweigh the weirdness.
At the end of the orientation. We signed a couple things like our W2s and a bunch of contracts. Typically it’s pretty normal but there was on document that stood out to me. It was something called a “brotherhood agreement” contract. Saying how if there ever needed to be voluntary kind of work, that I am volunteering in advance to help the company. I needed to sign it in order to be hired. So I unfortunately did.
Things started to fall apart on how this company is. I work over 40 hours a week these past couple months with no overtime pay. 70+ hours a week is now what I normally work. I was told it would happen sometimes ,but I was also told in my interviews, that they were going to take measures on us getting not that many hours to have a balanced and healthy life outside of work. So far nothing has changed according to coworkers that have worked there for a couple years.
There is clear favoritism. I am a guy that recently got his ears pierced. I have seen other guys that do similar work as me wearing earrings. Naturally, I didn’t think it was an issue. I spent a lot of money on new earrings and getting my ears pierced to only be told I couldn’t. When I asked the coworkers if they had been told anything about their earrings, they said that the actual COMPANY OWNER said that it’s okay because thats who he is. When I brought this up to my manager, he was told that I cannot at all wear them. HR told me the same thing.
And finally there was an unpaid “volunteer event” we had to attend on this past weekend (Friday - Sunday). We have certain shifts we must work but they want us to stay longer. There was a group chat message that was sent saying, and I quote “We cannot just show up, and work our shift then leave.” Unfortunately too, we have to attend because of the “brotherhood agreement” we signed. I reluctantly went despite working over 60+ hours this week. There are a lot more events in the future coming up that we must attend, set up, and tear down. Which again are all unpaid.
Now, I mentioned this to a family member who works in HR at another company and she was taken aback by all this. She says that what the company has us doing is even borderline not even legal. She says that this almost seems super cult-like and brainwashing. Having us work like dogs with no overtime pay for the sake of helping my “second family”. Plus, according to her knowledge, the document that we signed (“the brotherhood agreement”) cannot be enforced on us at all.
I do not plan on working for this company for much longer anyways, but my question to everyone here is:
What can I do from here? Is there maybe an attorney I should speak to? Is there someone or something I can call and report this company (if there is anything to report)? Or am I stuck in my situation because of my lack of research of this company? I probably don’t want to take legal action but maybe an attorney can help point me to the right direction.
