Indiana – Small Claims – Sued Personally Instead Of Llc (pet Care)

Location: Indiana

I own a pet-care LLC in Indiana. A client (a successful bookstore owner) has a lawyer and is suing me personally in small claims court instead of suing my LLC. I started this business as a way to help disabled people obtain part-time work while also helping pet owners save money by avoiding expensive kennel stays. My son has autism, and I care deeply about supporting the disabled community. This client was only my third.

She alleges I gave her puppy too many of its own treats while in my care, which she claims caused digestive issues and led to a vet visit. The puppy is a breed known for digestive sensitivity and was already on medication for anal/gastrointestinal issues prior to this incident. She also said he had access to a large container of cat food which is incorrect. What I said in my text, which I still have, is, “The puppy accidentally got into my cat’s food, but i immediately put it up. He had maybe a few tablespoons, if that.” I was honest.

While in my care, the dog appeared normal and healthy. I have time-stamped photos from that period. The treats were supplied by the owner. There is no veterinary statement directly linking the illness to treats given during my care or the tiny amount of cat food he consumed. She chose to take the puppy to an out-of-town urgent care vet approximately an hour away.

My services were performed under my LLC (contract signed under LLC name, payments made to LLC), and I carry business liability insurance.

Questions:

If services were provided through my LLC, can she pursue me personally instead of the business?

Is this the type of matter typically handled without an attorney in Indiana small claims?

I notified my liability insurance. They asked for receipts, details of what happened, etc. I provided everything except the vet bill as the pet owner won’t provide me that information nor the pet records.
