Is A Order To Show Cause Required For Response?
Location: MT
I was served a Petition for Contempt of Parenting Plan on the 8th of this month by sheriff dept. The form said it was filed on the 22nd of July.
It was just the petition and their affidavit. I thought there was an Order to Show Cause required for me to respond, because that was in each of the previous motions. I called the Clerk of Court and was told the case was "on a hold." When I asked about the lack of show cause form, they made it sound like that was needed and that there was no action for me to take. I have a Response prepared but did not file it yet. However yesterday, the 17th, the judged sent an Order via email granting coparent’s petition due to failure of me to respond. It stated it was mailed to me on the 22nd. It was not mailed to me, it was hand delivered by Deputy weeks after filed.
My first question is, Is the Order to Show Cause not required for me to respond?
Next, since I was served on a different date than stated, I should still be within the 14 days to respond, right? How do I fix this and have a chance to defend my position?
The forms and filing procedures are confusing to me. TIA!
