Is It Worth Suing My Builder?
I purchased a new construction home last year in Pennsylvania. There is a 150 ft steep hill behind the house that during walkthrough I said I was planning on planting things on this hill. We have now lived in the home for 14 months and this summer the hill severely eroded that required repair from the excavator. A swale was supposed to be on the top of the hill but it was obviously not working. After I insisted the builder paid for the excavator to come out and repair the swale and erosion in the hill.
The builder now wants me to sign a document saying I’m responsible for future repairs/erosion & stabilizing the hill. Landscapers told me planting on the hill will take years for roots to stabilize the hill & recommended a 3-4 retaining wall at the bottom of the hill to stabilize and lessen the slope.
Is this worth speaking to an attorney? I don’t want to sign this then have problems in a few months with the hill eroding.
