Landlord Mistakenly Gave Move Out Date Earlier Than Lease End, Now Wants Payment For Remaining Lease Term: How To Prevent Collections?
Location: Los Angeles, CA
Rented an apartment from a large company, decided not to renew the lease. Told the leasing staff that we wouldn't be renewing, they gave us a move out date that was 1 month before the end of the lease, but we didn't notice.
We moved out by that date. While doing the final accounting, they realized that they made a mistake on the move out date and the lease had another month left. They now want us to pay them rent for that month.
We've asked them to waive the last month's rent, arguing that we had to pay for alternate accommodations as a result of moving out on the date that they asked us to. The only communication they sent us was 'we were mistaken on your move out date, you still owe the last month of rent, we'll send it to collections if not received' and they haven't responded to any communication since.
What is the best way to deal with this? Is there some action that should be taken ahead of them sending it to collections, or do we just wait and then dispute it?
