Landlord Wants Me To Sign An Additional Document For Early Termination That Contains A Non-disparagement And Confidentiality Clauses That Were Not In The Lease.
Location: Indiana
The lease outlines the process and terms for an early termination very clearly: 60 days notice and a 2-months rent fee paid within 10 days of notice. When we notified the landlord of our requested early termination date and how to pay the fee, they responded six days later with an additional document that they wanted to be signed that included additional non-disparagement and confidentiality clauses that were not mentioned in the lease terms. When I asked for specifically the non-disparagement clause to be removed, it took them another week to respond that they would not do that. We are now beyond the 10 day window to make the payment because of their lack timely communication.
I believe that they are in violation of the Consumer Review Fairness Act and I don't want to sign an additional contract that seems to be exclusively to stifle criticism. Am I within my rights to demand that we follow the early termination clause that is stipulated in the lease that we signed?
Thanks!
