Man Strangles My Mom And Da Says It’s Impossible To File Charges

I just got off the phone with the DA with my mother and they said since the initial police report didn’t have anything about the strangulation and that no reports were made to the police until yesterday (incident happened in September) and the preliminary hearing has already happened, it is “impossible” to press that felony charge.

The police report took photos of her neck and documented it in the initial report and she couldn’t remember what happened since she had lost consciousness. The next day, I made my mom go to the ER because she was complaining of neck pain (she realized that she had been strangled) and I was worried of internal injuries. The forensic nurses documented it and told us that it would be sent to police and we thought we had done everything we were supposed to. There is plenty of evidence to prove strangulation.

I want a second opinion because this man is about to only get five years probation and only got charged with misuse of a weapon and third degree assault class E felony for body slamming her.

My mom is worried about any financial costs and also her safety and would feel better the sooner he’s on probation. I just don’t feel comfortable that in five years he will be free and that doesn’t feel like the safest option for our family. Any advice is welcomed and I’m curious as to why the DA said this was “impossible” because her explanations did not make sense to me. There might be more that I’m not understanding, but I can’t let a man that trapped her in her own home for hours and almost kill her walk away with five months of probation.
