Motorcycle Restoration Gone Wrong.

Hello,
I inherited a motorcycle from my father, a 1967 BMW with a sidecar. I am in Utah. I paid a shop in California over $33,000 for it to be completely restored. The initial timeline quoted by the shop was supposed to be around 10 to 12 months, it ultimately took 21 months to be completed.

I received the bike, and visually it looked good/acceptable, however, in under 40 miles of riding, I’ve had a complete brake failure incident due to a nut loosening (scary, with my wife in the sidecar at 45mph), the sidecar attachment also seems to have been under torqued, and now bolts are gouging into the sidecar, injuring the paint as well as the body of the side car, and the engine is also leaking oil.

It is very hard to find people to work on a bike like this, though I am trying to find someone locally to give me an estimate for the repairs.

I’m curious if anyone has any thoughts on applicable California law, or how to get this shop to take responsibility for completing the job. Given what I view as an outrageous cost to restore this vehicle, and the dramatically extended time it required, I do not think that it should have immediate issues like this.

The shop is claiming that I am “not mechanically inclined” and should seek out help for “standard maintenance of a vintage/antique motorcycle”. I don’t think that catastrophic brake failure, metal damage due to poor setup/alignment of the sidecar, nor oil leaks in under 40 miles of use represents ‘standard maintenance’.

I am in Utah, and this complicates things as shipping the bike takes weeks, and costs between 1500 and $2000 each way.

Do you have any thoughts? I’m not necessarily interested in seeking damages or making money, but I do feel as though for $33,000+ that the job should be correctly done and I’m willing to seek legal remedy.
