Move Out Fees
Location: San Jose, CA
Have been living in an apartment in San Jose that recently went through a lot of renovations: they repainted the outside buildings and the main office. They offered a cleaning fee, but I decided to clean it myself. My family and I spent hours making sure everything was spotless.
Come time to receive my deposit, they take $300 for cleaning and $300 for painting, even though the photos show the apartment have NO dirt or paint chipping. The comment states: resident charged for paint and general cleaning.
Emailed the apartment for an explanation why we were charged even though we cleaned the apartment, and how they can prove they needed to paint the apartment beyond wear and tear. Manager said they don’t have those statements, it was done in house, and determined it was just “necessary”. My friends live in this apartment as well and it appears they charged all of us this same $600 fee no matter the state of our apartment. To me, it seems as though they are charging us for the paint and new renovations, as well as cleaning no matter what, expecting us to not fight back.
My friend who went through something similar got a $1000 deposit back with a lawyer letter, however I don’t know any lawyers. Is it worth pursuing in small claims court?
