My Angel Of A Mom Got Served At Family Dinner…
Location: Missouri
During a family gathering my mother, who I am so surprised is in this position as she is an angel and feels the guilt of a million suns if she tells a white lie, just got served. She apparently owes $2200 to a debt collection agency for a credit card debt they bought that she had defaulted on. She said she does recognize the card balance and that it was unpaid. It does not appear to be small claims court but I may be wrong.
A few questions:
- She said she just wants to walk in on the day of court and pay them the money in full. This would hurt her financially. I also have a feeling she has to formally respond before court and not just show up.
- Is it realistic that (with my help) she does this without a lawyer since the amount being sued isn’t astronomical? It almost doesn’t make sense to hire a lawyer to get out of it since she may end up more in the hole.
- Does a debt buyer really have any legal ground to stand
on to sue? Should we be asking them to prove ownership?
- I want to help her, so any legal advice, through professional or personal experience would be very helpful. What questions she should be asking, how to respond, etc.
