My Question Is Regarding Assault, & Recording Someone Without Their Permission
Location: Charlotte, North Carolina
I (24F) have a roommate (31F) who I had issues with yesterday. I respectfully placed her clothes that were on the living room couch in front of her bedroom door with my landlords permission. her reaction: she got less than an inch from my face & screamed into it at least 4 times, shoved a door into me, pushed me twice, snatched my detergent lid out my hand & aggressively threw it, i went into the bathroom in the middle of all this to throw up from the anxiety & closed the door, she barged into the bathroom before i could lock it, hitting me with yet another door & hurting my arm, threatened to break my legos & mini houses that i’ve built, & said “i will do something & it will be the end” in my response to “what are you gonna do?” when she was screaming not to touch her things.
My landlord had told me & my other roommate that we were allowed to respectfully place her things at the front of her door if they are in our way in common areas, & her clothes were in my way & i didn’t harm a single thing of hers. i got all of this on video, my phone was in my pocket so there’s no visual, but you can hear everything very clearly including her threats. She was not aware i was recording.
To my question: If i were to press assault charges on her, would she be able to dismiss it on the grounds of her not being aware of being recorded?
