Neighbor's Contractor Removed Part Of My Fence And Built Their New One About 2 Feet Onto My Property
Location: Portland
Bought my house outside Portland about 3 years ago. My neighbor had their old fence replaced last week while I was away visiting family.
When I got back I noticed the new fence looked noticeably closer to my garage. I still had the survey paperwork from when I bought the place, so I measured it and unless I'm completely misunderstanding the survey, their new fence is roughly 2 feet inside my property line for about 45 feet.
I talked to the neighbor and he basically said the contractor followed where they thought the old boundary was and he's not paying to move a brand new fence. The contractor told me their agreement is with him and won't discuss it with me.
I can get another survey done if thats the first step, but I'm wondering who I'm actually supposed to deal with here. The neighbor, the fencing company, or both?
Also is this something I need to deal with immediately so it doesn't somehow become the accepted property line later?
