Nyc Security Deposit: Does A Saturday 14-day Deadline Extend To Monday?
Location: NYC. Dates changed for privacy reasons.
Tenants agreed termination date was May 31, but they finished moving out and confirmed returning the keys on Saturday, May 30.
Counting from the following day:
- Day 14: Saturday, June 13.
- Next business day: Monday, June 15.
I provided the itemized accounting and returned the remaining deposit after deductions that Monday. The tenants dispute the deductions and argue that returning the balance after fourteen calendar days means I forfeited the right to retain anything. They trashed the house.
Does General Construction Law §25-a extend the deadline under GOL §7-108 to Monday, even though that is the 16th calendar day after vacancy? Does departure before the agreed termination date affect the calculation, or does actual vacancy control?
Also, I doubt they could seek punitive damages, because I was in communication with them about the security deposit. Just slipped on a busy weekend.
I understand the validity of the deductions is a separate issue. I’m specifically interested in the deadline calculation and any cases directly addressing the weekend extension for security deposits.
If I'm wrong on the date calculation, fine. Lesson for me moving forward. Got busy with a dog passing away and another that needs a kidney removed! When it rains it pours!
