Optometrist Would Not Provide My Prescription: Isn’t This Illegal?

Location: Milwaukee WI

I had an eye exam on March 21, paid out of pocket. After the exam, staff said they were having “technical difficulties” with my prescription and told me to browse frames while they worked on it. About an hour later, I still hadn’t received it. When I asked, they seemed surprised I hadn’t picked out glasses. I left without the prescription.

Later that day I learned about the FTC Eyeglass Rule, which requires that a prescription be given immediately after the exam. I called back and requested my prescription; there were yet more excuses about why it’s not ready however they said they’d have it ready later. I received a phone call stating my prescription was ready and I returned the next day (March 22) and was handed a paper that had no doctor’s signature and no exam date—so it’s not a valid prescription.

Does this violate the FTC rule or any state laws in WI? What should my next step be—file an FTC complaint, contact a state agency, or something else?
