Roofer Took Deposit But Never Did Roof
Location: Clackamas County, Oregon
I hired a roofer on recommendation from a friend.
They gave a great estimate, had great reviews, and said they could do the work during a specific time window (a particular week in July).
We paid a 50% deposit (an amount close to $8000)
He never came to do the roof. He said “next week” several weeks in a row, only to stop responding altogether.
After over two months elapsed, we asked for a refund of our deposit. He did reply to this and said he would give us a refund, either mailing it or having someone drop it off for us.
It’s been 14 days since then, and despite me following up almost every day, he has gone completely radio silent.
Attempts to call him are met with a “voicemail full” response.
What our our legal options for getting our money back?
Our state has a contractors licensing board (CCB) that we can file a complaint with which would eventually go to mediation, but the CCB’s own website says that are not able to enforce money being refunded.
Should we file in small claims court? Civil court? Make a police report?
The deposit is just shy of $8,000.
