Spouse Wants To Divorce Without Legal Representation, How Dumb From 1-10 Would I Be To Agree?
Location: Virginia
Married almost 15 years, one school-age child. Spouse is active duty military. We own two houses, one is a rental. I make about half of what he does, likely less. The marriage has become untenable IMO and I would like to move towards divorce. I have no intention of filing for sole custody or anything like that.
He wants to write out an agreement for division of assets and custody on our own, and then take it to the required mediation session to eventually get it signed off on.
When angry, he has said things like “If you get a lawyer, I will take that as a threat and will spend all my money to ruin your life” (paraphrased but very close). He’s expressed that he doesn’t want me getting any of his retirement savings.
I’ve put things in writing about having suicidal ideation and have gone through his devices many times without his consent (history of cheating). We have fought in front of our child, she has seen me hysterical. OTOH I have screenshots of hundreds of messages from him that are threatening / hostile. He has physically threatened me multiple times although I don’t have proof.
Given all this, I’d be an idiot not to get a lawyer, right? Realistically, is there a pathway for him to fuck up my life and keep kid / $$ ?
