Teacher’s Car Damaged By Students During School Hours While On School Property

While walking in from recess, two students report that students were throwing rocks at a teacher’s car during recess and broke the windshield. The windshield did in fact break and needs to be replaced. The estimated cost is 1.4k. The school conducted an investigation and determined that they had no leads on which student was responsible and that there is nothing they can do for the teacher/owner of the car. The teacher chose to file a police report with the schools police officer against the school administrators’ wishes. The school is saying the parent of the child is liable, but because their investigation went nowhere, there is nothing more that can be done.

Is the school district liable for the damage? These students were assumed to be under direct supervision of 4 teachers during this time. The owner of the car was not one of the teachers directly supervising the students. The event took place during school hours. The car was parked on school property. There are no cameras in the playground/recess area. The students are 6th graders (11 going on 12)
