Ticketed For Possesion Of Paraphernalia Even Though I Am A Licensed Patient.
Location: South Dakota
My girlfriend was driving alongside a state trooper when all of a sudden he drops his speed and pulls us over claiming the speed limit dropped from 80 to 65 (true, our bad we missed it) Well I am a medical patient and had my MJ/pipe/container with me in the passenger seat. I denied ever smoking in the car and that the smell is only from the residue on my pipe. My girlfriend also completely denied smoking weed. Well she performed field sobriety tests and the trooper arrested her (I think I should mention her glasses actually broke as she was getting out of the car and she has terrible vision, was not able to see during the tests in 24° weather, 20mph winds)
He also charged me with possesion of paraphernalia and use of marijuana in a motor vehicle. Can he do this even though I denied smoking in the car? I'm sure it'll just be up to the lawyers and the judge in court.... what bullshit. Any advice or experience with this type of matter would be greatly appreciated, thanks.
