Title Ix Violation?
Location: Wisconsin, USA
My child (6yo M) disclosed to us that another child had been touching him sexually at school. Details were very specific that a kindergartener wouldn't have context to make up. We immediately reported it to LE who reported it to his school. Initially we were told hed be assigned a detective and have a forensic interview but instead they assigned the school resource officer and the principal interrogated him in her office. He was so scared he said he lied and asked to go back to class. She then yelled at him for lying. They refused to remove this student from class and when my son tried to tell this other child that he couldn't play with him, my son was removed from recess and told he had to go to the principals office because hes not allowed to exclude people. They told us there was no evidence it occurred so they were closing the investigation. We also never spoke to a CPS worker. Because they didn't complete a forensic interview, he cannot access any resources through our local agency who does child sexual abuse support (they only can provide if disclosure is made to them).
I contacted the superintendent regarding my concerns who refused to engage with me and gave me a very legal response("I acknowledge receipt of your concerns")
Is this a title IX violation? Everyone we have talked to after the fact outside the district has said this is not the correct process, including the people at the CSA agency.
We are interested in obtaining legal reprraentia to file a formal complaint against the district regaridng the handling of this. We are not looking for money, but for this not to happen to another family.
