Urgent: I’m The Sole Borrower On A Car Loan, But My Father Is The Sole Owner On The Title. He Cancelled The Registration And Refuses To Transfer Ownership. What Can I Do?
Location: Massachusetts
I’m in Massachusetts and need advice.
The auto loan is solely in my name. I’m the one making all the payments.
The title is solely in my father’s name.
He recently cancelled the registration (because he failed to pay his excise tax, he did this last year and it took forever to reregister the car) and is refusing to sign the notarized paperwork required to transfer the title into my name.
Nissan told me there is no workaround without his signature.
So I’m stuck paying for a car that I don’t legally own. If I stop making payments, my credit is affected. If I drive the car while it’s unregistered, I’m the one who could get ticketed or have it towed.
Do I have any legal options if the titled owner refuses to cooperate, or do I need to speak with an attorney? Please no judgement focus on the issue at hand.
ETA!!!:
I spoke with the dealership’s sales manager over the phone. He confirmed that I was the primary buyer (father co-buyer) and that it’s actually both my father and I are on the loan (even though I’m making all the payments). He also confirmed the vehicle was registered ONLY to my father, but refused (or was unable) to explain why. I’ve requested copies of all purchase, financing, title, and registration paperwork from the dealership so I can understand exactly how this was structured. I don’t know if this makes anymore sense to you guys?
