Use Of The Term “free” When Something Being Sold Bundles, But Not To $0.
Location: Michigan, United States (every state, it’s a national chain store, I just put in a random state to satiate the algorithm).
Some employees and I are debating wording used at big chain store in the US.
In this case there is a product that is priced at, say $500 on the display sign. It’s marked as “free install”.
At the register when you ring it up it automatically adds the install service (can’t be sold without it, as per contract with the device manufacturer). It will bundle to $250 for the product, and $250 for the labor. So a total of $500 still, matching the advertised price, but not technically “free” when broken down.
We’re trying to figure out if this is legal in how it’s advertised. Of course something like “install included” would work, but the “free” wording is what has us wondering.
Also worth noting, if someone purchases this, gets it installed, changes their mind, and return it, they would only receive $250 back, since the install was already completed and can’t be “returned”.. whereas if install was “free” one would expect the whole $500 to be returned.
Thanks for any insight!
