Wedding Venue Won’t Pay Us Back Our Refundable Deposit (4+ Months)

My partner and I had just gotten engaged in September and when we started to venue hunt quickly realised how fast things move. We found this venue that’s run by a couple and doubles as a camp in the summertime which sends kids who cannot afford summer camp for free (and part of the wedding venue fees support this project of theirs). We thought this was a really cute small business an had a great chat with the owner and decided to put a $5,000CAD fully refundable deposit down on this venue to secure our date (a popular long weekend).

We went to tour the venue that weekend and the owner cancelled on us last minute saying his father had fallen and maybe broken his hip. He walked us through how to find the master key and allowed us to view the entire property. We decided this venue wouldn’t suit our or our guests needs and informed them within a few days that we would like our refundable deposit back.

Fast forward to now, almost 5 months later, we have received 2/3 of the deposit (still waiting on $1,500) and countless text messages with excuses (work, basketball tournament, flu, dad fell again, and the flu again) we don’t see an end in sight. It was admitted in an email that the company spent our deposit as we assume they are waiting for someone else to book before we will get our money back.

Is there anything we can do here?
